OFFICIAL RULES & PRIVACY POLICY 2020-2021

OFFICIAL RULES

Must be 18 years of age or older to enter.

Do not proceed to enter if you are not at least 18 years of age and a legal resident of, and located within, the state of Missouri or Kansas, within a 100 mile radius at the time of entry. Your participation in the Giveaway constitutes the entrant’s (“Participant,” “Entrant,” “you,” or “your”) full and unconditional agreement to and acceptance of these Ofﬁcial Rules, including the decisions and interpretations of Sponsor and/or the judges, which are ﬁnal and binding on all matters relating to the Giveaway.

The winner of the Dream Wedding Giveaway, will receive goods and/or services in connection with the wedding ceremony/reception to be held in 2022. All goods and/or services will be provided at The English Barn, located at 26806 Metcalf Road, Louisburg, Kansas.

NOTE: The date of the “Dream Wedding” cannot be changed. Entrants should not apply for the Giveaway unless they are available on this date. The goods and/or services awarded as part of the Giveaway have no cash value, are non-transferrable, non-assignable and may not be exchanged or refunded under any circumstances.

GIVEAWAY PERIOD: The Dream Wedding Giveaway (kcdreamwedding.com) (the “Giveaway”) runs from February 14, 2021 to, May 1, 2021 at 12:01 AM Central Time (“CT”). Our finalist will be chosen by the Dream Team.

SPONSOR: The Giveaway is sponsored collectively by those entities listed on the website. Each of the entities provided, including their subsidiaries and afﬁliates, and any other partnering companies or agencies associated with the Giveaway, together, hereinafter will be referred to as the “Giveaway Partners.”

Application: In order to register for the Giveaway, entrants must supply the following information during the Application Period collectively, the “Application Materials”:

a. A compelling and heart warming love story in writing.

b. A story of how the entrants met and why they should be selected to win the Dream Wedding Giveaway

c. At least three (3) personal reference to verify the contents of the Application materials.

d. Participates valid phone number, email address and physical address.

e. A 4×6 photo of you both together, that can be used on social media.

HOW TO ENTER: During the Giveaway Period, there is 2 ways to enter.

1. Online Method of Entry: You may enter the Giveaway by submitting the Application Materials via e-mail to: theenglishbarn@lilycreekfarms.com

2. Mail-In Ballot Method of Entry: You may also mail a letter/story with your full name, full address, city, state, telephone number, email address, to: Dream Wedding Giveaway, 26806 Metcalf Road, Louisburg, Kansas 66053.

Regardless of method of entry, all entries must be received by the Giveaway End Date (May 1, 2021, at 11:59 PM CT). To enter the Giveaway, each entrant must complete the entry form with all required information (which will include your full name, full address, city, state, telephone number, email address, and agree to these Ofﬁcial Rules. All entries become the property of Sponsor and will not be returned.

Sponsor reserves the right, in its sole discretion, to: (i) verify any element of any entry, related materials or entrant’s eligibility; (ii) to request additional information; and (iii) to disqualify any entrant whose participation may subject the Giveaway, Sponsor or Sponsor’s advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule. By entering the Giveaway, you agree to provide any documentation or information deemed necessary by, and in a form acceptable to, Sponsor to satisfy the above requirement if asked by Sponsor to do so.

ELIGIBILITY: The Giveaway is open to all legal residents of the state of Missouri and Kansas who are 18 years old or older at the time of entry. Void elsewhere and where prohibited. Persons in the following categories are NOT eligible to enter the Giveaway or win Giveaway prizes: any person who on or after February 14, 2021, was or is: (a) a Giveaway Partner owner or employee; (b) a director, ofﬁcer, employee, agent, or independent contractor of Sponsor, or its parent company, subsidiaries, afﬁliates, or service agencies; (c) any entities retained by Sponsor for the administration of the Giveaway; (d) an immediate family member (deﬁned as parents, parents-in-law, children, siblings and spouse (including common law), regardless of where they reside); or (e) any exhibitor or sponsor of an event organized by the entities, including any director, ofﬁcer, employee, agent, or independent contractor thereof. Any other persons with whom any of the above are domiciled are also not eligible to enter the Giveaway or win Giveaway prizes.

WINNER NOTIFICATION: If your entry has been drawn as a winner, you will be contacted by telephone, email, mail or in person by our sponsors and ﬁlming crew. To be conﬁrmed a winner of any prize, you may be required to complete and return an afﬁdavit of eligibility, release form, or other verifying documents requested by Sponsor before being awarded your prize. If a winner does not meet all eligibility requirements, has not complied with these Ofﬁcial Rules, cannot be contacted, does not respond within seven (7) days from the date Sponsor ﬁrst tries to notify him/her, and/or the prize or prize notiﬁcation is returned as undeliverable, such winner forfeits all rights to claim or receive the prize and an alternate winner may be selected. By accepting any prize, winner acknowledges compliance with these Ofﬁcial Rules. THE PRIZE IS AWARDED AS IS AND WITHOUT CONDITION, WARRANTY, GUARANTEE OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE).

PRIZE DETAILS/RESTRICTIONS:

A “ Dream Wedding ” is an sponsored event that is (1) speciﬁcally related to the winner’s wedding, including but not limited to attire, ceremony, reception venue, catering, photography, but does specifically exclude all forms of alcohol; (2) related wedding that occurs on date speciﬁed.

In order to be Qualiﬁed, the winner must also submit a valid marriage license naming the selected winner as a party of a marriage that was issued on or after the Giveaway Start Date and within 12 months from the Drawing Date to the Sponsor. And sign a contract with The English Barn and participating vendors.

PROOF OF INSURANCE: As the winner of this Dream Wedding, you will be required to provide A Certiﬁcate of Liability Insurance. The cost is around 349.00 and is part of the winner responsibility. The certiﬁcate must list “ The English Barn, at Lily Creek Farm LLC” as additionally insured. The insurance certiﬁcate must explicitly state the following conditions: This is a day(s) endorsement for bodily injury and property damage. The certiﬁcate must show the date of the event and the name of the rental party.

a. A $1,000,000 per occurrence, and $2,000,000 aggregate of Bodily Injury and Property Damage Liability Limits must be included in the coverage: b. The English Barn, at Lily Creek Farm LLC, it’s owners, officers, agents and employees , participating vendors must be named as additional insured for any claims resulting from or arising out of the winners. Please Contact: Elliott Insurance for you event policy, 913-837-5125 – ask for Colton Kueser. Colton will send your policy to our office within 30 days of your event . Failure to provide evidence of this insurance to the Venue, 30 days prior to the Event, will cause immediate cancellation of the Event and it’s winners contract.

CONTACTING SPONSOR: Any notice, documentation, etc. that are to be provided to the Sponsor may be provided using either of the following methods:

Electronically by email at The English barn.com (Please include DREAM WEDDING GIVEAWAY in the subject line of your message); or

By postal mail at Dream Wedding Giveaway, P.O. Box 1117, Louisburg, Kansas 66053.

PRIVACY: When you register, we collect personal identifying information about you, including your name, mailing address, and email address. Sponsor may also include your contact information in lists that Sponsor provides to third parties for marketing purposes. For more information about how Sponsor uses the information you provide, see Sponsor’s privacy policy available here (the “Privacy Policy”) and the privacy policy of the Giveaway Partners, available at their individual websites.

IF YOU DO NOT WISH TO SHARE YOUR INFORMATION, DO NOT ENTER THIS GIVEAWAY.

By entering the Giveaway, you acknowledge that you have read and understand the Privacy Policy and you agree to its terms.

Indemniﬁcation and Hold Harmless Agreement: All entrants agree to indemnify and hold the Venue, The English Barn, and property of Lily Creek Farm LLC, it’s ofﬁcers, agents, and employees, and all participating vendors and suppliers, harmless from and against all liability, claims, actions, demands or losses of any kind, and any person it employs from injuries or property damage/loss to others during the rental event, including but not limited to death, personal injury, property damage, or any other incidents that may occur to any person(s) by use for the premises during the term of the agreement. The term of agreement starts upon execution of agreement and/or when the ﬁrst contractor, vendor or guest arrives on the property and concludes when the last contractor or guest leaves the premises. Vendors of any service or products brought in are solely responsible for damages resulting from the sale of unsafe or unsound goods. Winner agrees to pay all cost and attorney fees incurred by the Venue and it’s representative in defending any such claim or action brought against the Venue and it ’s representatives. All entrants acknowledge and agree that review of all applications, selection of finalists and selection of the winner is at the sole discretion of the “Giveaway Partners”, and all entrants agree to accept the decision of the “Giveaway Partners” as final and binding – without recourse.

PUBLICITY: Except where prohibited by law, entry into the Giveaway constitutes permission to use each entrant’s name, hometown (city and state), voice, biographical information, likeness, photograph/still or video, and any statements regarding this Giveaway in all media now known or hereafter discovered, for any purpose, including without limitation, in connection with, and to promote, market or advertise, the Giveaway, in whole or in part, without review, approval, credit or attribution, notiﬁcation or payment from or to entrant or any person or entity, worldwide, in perpetuity, or on a winner’s list, if applicable. By entering this Giveaway, you agree to be photographed and interviewed by the Sponsor for publicity purposes and when given reasonable notice given by the Sponsor. Giveaway is subject to all applicable U. S. federal, state and local laws and regulations.

Photography: This venue uses live, video and still photography to assist with promotion of the venue. All photos taken at The English Barn, at Lily Creek Farm LLC, by any Photographer will also be the property of the Venue and will be used for promotional purposes. NO boudoir or nude photography is permitted anywhere at The English Barn, at Lily Creek Farm LLC.

DISQUALIFICATION: The following are prohibited and will result in automatic disqualiﬁcation from the Giveaway: (1) using any method that artiﬁcially increases odds of winning, (2) non-compliance with these Ofﬁcial Rules; and (3) any other act which the Giveaway Partners determine, in their sole discretion, jeopardizes the integrity of the Giveaway, is unsportsmanlike, or is intended to annoy or harass any other entrant or Giveaway Partner. ARBITRATION/CHOICE OF LAW:Except where prohibited law, participants agree that any and all disputes, claims and causes of action arising out of or connected with this Giveaway shall be resolved exclusively by arbitration pursuant to the Rules of the American Arbitration Association then effective, and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by entrant with regard to this Giveaway, excluding in all events attorneys’ or other related fees and punitive, exemplary, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with the Giveaway shall be governed by and construed in accordance with the laws of the State of Kansas, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Kansas or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Any arbitration proceedings commenced under this Section shall be exclusively situated in Paola, Kansas.

WAIVER OF LIABILITY:. All entrants and winner(s) of the Giveaway agree the Sponsor shall have no liability and shall be held blameless for any injury, misfortune or damage to either persons or property insured by entering, participating in, winning or losing the Giveaway by use or non-use of any prize received. Entrants, including their heirs, successors, and assigns, expressly, intentionally, and knowingly waive any and all claims for damage of any kind arising out of or relating to the entry and/or participation in the Giveaway.

GENERAL TERMS AND CONDITIONS: This Giveaway is void where prohibited by law. The Giveaway is subject to all applicable federal, state, and local laws and regulations. By participating in the Giveaway, each participant agrees to release and hold harmless the Giveaway Partners and each of their respective employees, ofﬁcers, afﬁliates, parents, subsidiaries, directors, shareholders, agents and legal advisors (collectively the “Released Parties”) from any and all losses, damages, rights, claims and actions of any kind in connection with the Giveaway or resulting from acceptance, possession or use of any prize, including, without limitation, any personal injury, death or property damage. Under no circumstances shall any of the Released Parties have any liability or responsibility for: (a) incorrect or inaccurate entry information, or faulty, failed, garbled or jumbled electronic submissions, (b) any unauthorized access to, or theft, destruction or alteration of entries at any point, (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the Giveaway, (d) inaccessibility or unavailability of the Internet or a Giveaway site or any combination thereof, (5) any injury or damage to a participant’s or to any other person’s computer, laptop, tablet, cell phone, or other mobile device that may be related to or result from any attempt to participate in the Giveaway or download any materials in the Giveaway, or (6) any typographical error or other error in these Ofﬁcial Rules or in any other communication relating to the Giveaway. Copying or unauthorized use of Sponsor’s copyrighted materials, trademarks, or any other intellectual property without express written consent from Sponsor is strictly prohibited. All entries become the property of Giveaway Partners.

This privacy notices discloses the privacy practices for The English Barn and the Sponsors (Giveaway Partners) of the Dream Wedding Giveaway (“Contest”)

The Giveaway Partners are the sole owners of the information collected through the contest. We only have access to/collect information that you voluntarily give us via the application materials, email or other direct contact with you.

When you register, we collect personal identifying information about you, including your name, mailing address, telephone number and email address. The information that you provide will be added to a centralized database of the contest entrants. By entering and providing the required registration information, you acknowledge that the Giveaway Partners, as well as the Sponsors, Partners, Advertisers, or Exhibitors of the Contest Partners, may send you information or special offers believes may be of interest to you. Sponsors may also include your contact information in lists that the Contest Partners provide to third parties for marketing purposes.
